I am directed by Secretary Sir Samuel Hoare to inform

you that he has had under consideration your letter

No.53682/35 of the 13th November relative to the Hong Kong

Ordinance No.39 of 1935, concerning the deportation of aliens

and that he does not wish to offer any observations on the

terms of the Ordinance.

With regard to the suggestion contained in paragraph

2 of the Secret despatch of the 18th September last from the

Officer administering the Government of Hong Kong, I am to

invite reference to the third paragraph of the letter of the

4th September, 1933, from this Department and to inform you

that Sir Samuel Hoare would be prepared to concede that,

having regard to the special circumstances of Hong Kong in the case of deportees of Chinese race travel documents issued by

the Chinese authorities will not ordinarily be required;

provided, however, it is clearly understood that the words at

the end of Section II sub-section (a) of the Ordinance will in

all cases be interpreted in the sense that the Governor, is

satisfied, after making all proper enquiries, that the deportee is

a national of the country to which he is sent and there is no

reason to suppose that this will be denied by the authorities

of that country.
